Please read these Terms and Conditions carefully before accessing or using this App By accessing or using the “CashLeaf APP”, you agree to these Terms and Conditions. “CashLeaf” reserves the right to change, modify, add or remove portions of the terms at any time. Please check these terms periodically for changes. 1. LIMITATION OF LIABILITY
Your use of the “CashLeaf APP” is at your own risk. To the maximum extent permitted by law, neither “CashLeaf” nor any other party involved in creating, producing or delivering the app, will be liable for any direct, indirect, incidental, consequential or punitive damages (including, without limitation, loss of profits, cost of substitute service or lost opportunity), howsoever caused, arising out of your access to, use of, or reliance on the app, even if “CashLeaf” has been advised of the possibility of such damages. Without limiting the foregoing, “CashLeaf” assumes no responsibility for, and will not be liable for any damages relating to or caused by any viruses which may affect your computer equipment or other property on account of your access to, use of, or downloading from, the App. “CashLeaf” cannot and does not guarantee continuous, uninterrupted or secure access to the App. You specifically acknowledge and agree that “CashLeaf” is not liable for any defamatory, offensive, fraudulent, or otherwise illegal conduct of any user.
1.1. You must be truthful. You agree to provide true, accurate and complete information about yourself as prompted (“Account Data”) and you confirm that you have full authority to provide the Account Data including in particular the information relating to the person you have provided as your emergency contact. You agree to indemnify and keep us indemnified in full against all demands or claims that may be brought against us with respect to any information related to third parties provided by you to us during your use of the Service including any information related to your emergency contact. You also agree to update the Account Data to keep it current.
1.2. You authorize us to verify your information. You hereby authorize us to conduct information verification checks on you should we deem it necessary. You further duly authorize us to forward your Account Data and personal information to verification suppliers, information suppliers and third parties acting on behalf of Blue Ridge to verify information about you which includes but is not limited to qualification, certification, employer background screening, employment verification, employment references, criminal records, driver’s license validation, passport validation, identity verification and any other personal information required to validate, verify and confirm your information. You understand and agree that your consent declaration will remain valid indefinitely for all existing and future personal and verification requests, screening, validation and confirmation of information regarding yourself.
1.3. You must keep your account secure. You are responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur through the use of your account or password. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. Utilisation of your account by either yourself and/or any other individual shall be deemed to be an authorised transaction and hereby indemnify us against and waive any claims relating to the unauthorised use of your account.
1.4. Our fee is payable on top of the amount you borrow. Following the account registration process, you may be offered the opportunity to apply for Loans in certain amounts. We reserve the right to decline the Loan application for any reason. However, if we accept your application and grant you a Loan we will charge a fee you must pay to us on top of paying back the borrowed amount (“Origination Fee”). The Origination Fee payable is stated together with the loan amount at the time you apply for each Loan. The Loan shall be credited into your “CashLeaf” Account less deduction of the applicable Origination Fee.
1.5. You must repay by the Due Date or rollover your Loan. You must repay the Loan by the date specified when you take the Loan (“Due Date”). It is important that you repay the Loan and Origination Fee by the Due Date. If you fail to do so, we will at our discretion rollover your Loan for a period of time determined by us (“Rollover Period”) and charge you an additional fee (“Rollover Fee”) in the amount of 3.5% per day. You must then repay the loaned amount, Origination Fee and Rollover Fee by the end of the Rollover Period.
1.6. If you fail to repay, you will be in default. If you still have not repaid the Loan amount and fees, by the end of the Rollover Period, you will be in default. This default may be reported by us to credit reference bureaus duly licensed under the Credit Reporting Act 2017, within 28 (twenty- eight) days of your default and such report may affect your ability to borrow money in the future. You will become responsible for the reasonable costs we or our suppliers may incur in collecting the payment in accordance with applicable law. Overdue amounts will be rounded up to the nearest whole Nigerian Naira.9. “CashLeaf” Agent Loans and Origination fee. Where a Loan is provided to you in your capacity as a registered “CashLeaf” Agent, you acknowledge and agree that that the Loan will be subject to origination fee at a rate of zero point four percent (0.4%) per day.
1.7. We may contact you and/or your emergency contact. You expressly agree that, as part of the Service, you may, from time to time, receive communications from us via text message (SMS) or email, including our promotional newsletters or other information about the Service. You may stop receiving promotional messages by following the opt-out instructions in the message. Even if you choose to opt out of receiving promotional messages, you may not opt out of receiving service-related messages. You also expressly authorize us to contact your emergency contact to verify your information, when we are unable to contact you or when we have not received a repayment from you. You confirm that your emergency contact has consented to the sharing of his/her information with us and to us contacting them with respect to your use of the Service. In the event we cannot get in contact with you or your emergency contact, you also expressly authorize us to contact any and all persons in your contact list.
2. INDEMNITY
You agree to indemnify and hold “CashLeaf”, its subsidiaries or affiliates, and their respective directors, officers, employees, and agents, harmless against any and all liabilities, claims and expenses, including reasonable attorneys’ fees, arising from breach of these Terms and Conditions, any other related policy, your use or access of the App or any Internet site linked to or from the App, or in connection with the transmission of any content on the App.
3. AUTHORISED USE
The information provided on this App is solely for the personal use of App users. You are authorised to view and copy the information available on this App for personal purposes only, provided that any copies include any trade mark notices as they may appear on those pages copied. Except for the personal use of App users, you may not copy, reproduce, modify, display, distribute, perform, disseminate, transmit, transfer, sell, license, publish, use to create a derivative work, or use for any public or commercial purposes any of the contents of this App without the express prior written consent of “CashLeaf”. You agree to access and use the App only for lawful purposes.
4. SECURITY
We welcome your email correspondence. But Internet and email communications are not confidential. It is possible that information transmitted to us may be read or obtained by other parties. In an attempt to protect your privacy, our email responses do not include personal account information such as your BVN or bank account numbers. Email is an important communication channel for our App’s visitors. We will use your email address and the content of any email for correspondence purposes and to meet our legal and regulatory requirements regarding customer communications. On occasion, we may use your email address to send you communications with information about service and product information that we believe may be of interest to you. If you do not want to receive such unsolicited communications from us, please send us a message to this effect.
5. GOVERNING LAW
You agree that the use of this site shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
